A police officer questioned R. R. as part of the officers investigation of an attempted vehicle break in. The officer did not advise R. R. of his Miranda rights and R. R. made incriminating statements. The trial court found that the statements were nevertheless admissible because R. R. was not in custody when he made them and found R. R. guilty of the attempted taking of a motor vehicle and malicious mischief. R. R. argues on appeal that his statements should have been suppressed. The State has conceded that the evidence does not support a determination that R. R. was not in custody when he was questioned and agrees that the error was not harmless.
